Thank you for choosing to join the MT Lab community (also referred to in this document as “Company”, “we”, “us”). We are committed to protecting your personal information and your right to privacy. If you have any questions or concerns about our policy or practices regarding the use of your personal information, please contact our Privacy Officer.

When you visit our mtlab.ca Web site and use our services, you entrust us with certain personal information. Your privacy is important to us. In this privacy policy, we want to explain as clearly as possible what information we may collect, how we use it and what your rights are with respect to it. We advise you to take the time to read it carefully, as it is essential for us to be completely transparent with the users of our services. If there are any terms in this privacy policy with which you disagree, please do not continue to use our sites and services.

This Privacy Policy applies to all information collected via our website (mtlab.ca) as well as through any of our services, such as sales, marketing or related services (we refer to these in this Privacy Policy as the “Services”).

1. What information do we collect?

Personal information you voluntarily disclose to us

In short, we collect the personal information you provide when you send us an e-mail.

We collect the personal information you voluntarily provide to us when you express an interest in obtaining information about us or our products and services, when you participate in activities on the Services or when you contact us.

The personal information we collect depends on the context of your interactions with us and the Services, the choices you make and the products and features you use.

Information collected automatically

In short, certain information – such as IP address and/or browser and device characteristics – will be collected automatically when you use our Services.

We automatically collect certain information when you visit, use or browse the pages of our various Services. This information does not reveal your specific identity (such as your name or personal details) but may include information about the device used, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is mainly required to maintain the security and operation of our Services, as well as for internal analysis and reporting purposes.

Like many companies, we also collect information via cookies and similar technologies.

Online identifiers: we collect cookie identifiers, or other identifiers, such as those used for analytics and marketing, such as device geolocation; tools and protocols, such as Internet Protocol (IP) addresses; devices; applications; as well as other similar data.

Information collected from other sources

In short, we may collect limited data from public databases, marketing partners or other external sources.

We may obtain information about you from other sources, such as public databases, joint marketing partners and other third parties. For example, the information we receive from other sources includes: profile information on social networks; marketing data and search results; and links, including paid listings (such as sponsored links). We will inform you of the source of the information and the type of information we have collected about you within a reasonable period of time after we have obtained the personal data, ensuring that this period does not exceed a period of one month.

2. How do we use your information?

In short: We use your information for purposes based solely on legitimate business interests, in connection with the performance of our contract, all in compliance with our legal obligations and/or your consent.

We may use personal information collected via our Services for various business purposes described below. We process your personal information for these purposes based on our legitimate business interests; in order to enter into or perform a contract with you, with your consent, and/or to comply with our legal obligations. We indicate the specific processing grounds on which we rely next to each purpose listed below.

We use the information we collect or receive:

To send you marketing and promotional communications. We and/or our third-party marketing partners may use the personal information you send us for the purposes of developing a marketing strategy, if this is consistent with your marketing preferences. Please note that you may opt-out of receiving marketing emails from us at any time.

To offer you targeted advertising. We may use your information to develop and display content and advertising (and work with third parties who do so in collaboration with us) tailored to your interests and/or location, in order to maximize its effectiveness.

To protect our services. We may use your information as part of our efforts to ensure the security of our services (for example, for fraud monitoring and prevention).

Respond to user requests / offer user assistance. We may use your information to respond to your requests and resolve any potential problems you may encounter while using our Services.

For other commercial purposes. We may use your information for other business purposes, such as analyzing data, identifying usage trends, evaluating the effectiveness of our promotional campaigns, or evaluating and improving our services, marketing products and your experience. We assure you that we are careful to use and store this information in an aggregated and anonymized form, so that it is not associated with individual users and does not include any personal information. Rest assured, under no circumstances will we use any personally identifiable information without your consent.

3. Will your information be shared with anyone?

In short, we only share information with your consent, in order to comply with the law, to provide you with required services, to protect your rights or to fulfill business obligations.

We may process or share data on the following legal basis:

  • Consent: We may process your data, if you have given us specific consent, allowing us to use your personal information for a specific purpose.
  • Legitimate interests: We may process your data, where reasonably necessary, in order to achieve our legitimate business interests.
  • Contract performance: Where we have entered into a contract with you, we may process your personal information for the purpose of fulfilling the terms of that contract.
  • Legal Obligations: We may disclose your information, where we are legally required to do so, in order to comply with applicable law or governmental requests. Whether in response to legal process, court order or subpoena (including in response to public authorities to meet national security or law enforcement requirements).
  • Vital interests: We may disclose your information when we believe it is necessary to investigate, notify appropriate authorities or take action regarding potential violations of our policies. This may include suspected fraud, situations involving potential threats to the safety of any individual, illegal activities, or to be used as evidence in litigation in which we may be involved.

Specifically, we may need to process your data or share your personal information in the following situations:

Business transfers. We may share or transfer your information as part of, or during negotiations for, any merger, sale of business assets, financing or acquisition of all or part of our business by another company.

Third-party advertisers. We may use third-party advertising companies to serve ads when you visit pages linked to our Services. During your visits to our Web sites, these companies may use information contained in Web cookies and other tracking technologies to deliver targeted advertisements about products and services of interest to you.

4. Do we use cookies or other tracking technologies?

In short, we may use cookies and other tracking technologies to collect and store your information.

We may use cookies and similar tracking technologies (such as web beacons and pixels) to access or store your information. Specific information on how we use these technologies, and how you can refuse certain cookies, is set out below.

A cookie is a piece of data that is stored on your device to help websites and mobile applications remember things about you.

We use first-party and third-party cookies for several purposes:

Performance – We use first-party and third-party cookies to track your use of features and content categories. This allows us to focus on what matters most to you and to make these features and content elements more accessible and easier to use, in order to create a more convenient browsing experience.

Personalization – We use first-party and third-party cookies to track and target your interests based on your usage profile. For example, we may remind you to use a feature you haven’t used in a while or display content in your language.

Analytics (data analysis) – We use first-party and third-party cookies to analyze trends and understand what’s working on our website and app and what’s not. This helps us to consistently deliver the highest quality and most relevant content possible.

Refusal of cookies on this site

Most browsers are initially configured to accept cookies. However, you can also disable cookies if you wish, usually by modifying your browser settings. It is also possible to configure your browser settings to enable the use of specific cookies, or to notify you each time a new cookie is about to be stored on your computer, allowing you to decide whether or not to accept it. 5. How long do we keep your information?

In short, we retain your information for as long as necessary to fulfill the purposes described in this Privacy Policy, except as otherwise required by law.

We will only retain your personal information for as long as is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements).

When we no longer have any ongoing legitimate business need to process your personal information, we will delete or anonymize it, and in the event that this is not possible (for example, because your personal information has been stored in a backup archive), we will store it securely. Your personal information will be exempt from any further processing, until such time as its final deletion is possible.

6. How do we keep your information safe?

In short, we aim to protect your personal information through a combination of organizational and technical security measures.

We have implemented appropriate technical and organizational security measures to protect your data. However, please bear in mind that we cannot guarantee that the Internet itself is 100% secure. Although we do our best to protect your personal information, the transmission of personal information to and from our Services is at your own risk. You should only access our Services using a fully secure connection.

7. Do we collect information from minors?

In short, we do not knowingly collect data from, or market data to, children under the age of 18.

We do not solicit or market data from children under the age of 18. By using the Services, you represent that you are at least 18 years of age or that you are the parent or guardian of such a minor and that you consent to the use of the Services by such minor in your care. If we learn that personal information has been collected from users under the age of 18, we will deactivate the account and take reasonable steps to promptly delete such data from our records. 8. What are your privacy rights?

In short, you can review, modify or terminate your account at any time.

If you reside in the European Economic Area and have reason to believe that we are unlawfully processing your personal information, you are entitled to lodge a complaint with your local data protection supervisory authority. Cookies and similar technologies: most web browsers are configured to accept cookies by default. If you prefer, you can also set your browser to delete or refuse cookies. If you choose to delete or refuse cookies, however, this may affect certain functions related to our Services. 9. Data breach

A privacy breach occurs when there is unauthorized access, collection, use, disclosure or disposal of personal information. You will be notified of data breaches if MT Lab determines that you are likely to be at risk of serious harm. For example, if a data breach may be likely to result in serious financial harm or harm to your mental or physical well-being. In the event that MT Lab becomes aware of a security breach that has resulted or may result in unauthorized access, use or disclosure of personal information, MT Lab will promptly investigate the matter and notify the relevant supervisory authority no later than 72 hours after becoming aware of the breach, except in cases where the personal data breach is unlikely to result in a risk to the rights and freedoms of natural persons.

10. Do Not Track (DNT) policy.

Most web browsers, as well as some mobile operating systems and mobile applications, include a function, or Do-Not-Track (“DNT”) setting, that you can activate to signal your privacy preference, and thus refuse to have data on your online browsing activities monitored and logged. No uniform technological standard for the recognition and implementation of DNT signals has yet been adopted. As a result, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. Should a standard regarding online tracking be adopted in the future, we will inform you of our desire to comply with it in a revised version of this Privacy Policy.
